Welcome to Fenden! These Terms of Service ("Terms") govern your access to and use of our platform and services, including the creation, configuration, and interaction with AI agents connected to personal APIs.

By using our services, you agree to comply with and be bound by these Terms.

1. Services

Fenden is a platform for building and deploying intelligent agents. Our services include:

Creation and configuration of AI agents
Integration with external APIs
Deployment via UI or API
Document search and vector storage
Conversation history and analytics (optional)

We may add, modify, or remove features at our discretion to improve the platform.

2. User Accounts

To use Fenden, you must:

Be at least 18 years of age
Provide accurate and complete registration information
Be responsible for the security of your login credentials

We may suspend or terminate your account if it violates these Terms or poses a security or legal risk.

3. Subscriptions & Billing

Some features require a paid subscription. All payments are securely processed through Paddle.

Subscriptions auto-renew unless cancelled in advance
You can cancel at any time
Refunds are governed by our Refund Policy

4. Conversation History & Privacy

When using chatbots on Fenden, your interactions may be stored for the purpose of enhancing functionality and user experience.

Only you, or individuals you explicitly authorize, can access your stored conversation history.
You may disable history on a per-agent basis, especially when using agents via API.
If disabled, conversations will not be stored or made visible through the Fenden dashboard.

You remain in control of your data visibility at all times.

5. Acceptable Use & Content Restrictions

You agree to use Fenden only for lawful and ethical purposes. Fenden is designed for enterprise-grade automation and productivity workflows, not for entertainment or misuse.

Prohibited Uses:

Generating or distributing malicious, harmful, or deceptive content
Creating or facilitating deepfakes or impersonations
Generating content that is illegal, discriminatory, violent, or abusive
Attempting to bypass security or exploit vulnerabilities in the system
Violating intellectual property rights of others
Misusing API integrations without proper authorization

Format Restrictions:

Our agents only support plain text and structured formats like JSON
Any attempts to generate multimedia, deep fake videos, or audio content are strictly prohibited
Executable code, or other potentially harmful outputs are not permitted

We reserve the right to monitor, restrict, or remove content or accounts that violate these terms.

6. Intellectual Property

All content, software, and design elements on Fenden are owned by Fenden or its licensors.

You retain ownership of:

Your uploaded data and documents
Custom prompts and agent configurations
API connections and integrations

You may not use Fenden’s branding or assets without express written permission.

7. Disclaimers

Fenden is provided “as is” and “as available.” We make no warranties regarding:

Uptime or uninterrupted availability
Accuracy or reliability of AI-generated responses
Compatibility with third-party services

Use of the platform is at your own risk.

8. Limitation of Liability

To the maximum extent permitted by law, Fenden shall not be liable for any indirect, incidental, or consequential damages arising from your use of the platform.

This includes, but is not limited to, data loss, service interruptions, or third-party access through integrations.

9. Modifications to Terms

We may update these Terms periodically. If significant changes are made, we will notify you via email or within the platform.

Continued use of Fenden after such updates implies your acceptance of the revised terms.
